Batsheva Photography - Terms & Conditions
Please read these Terms & Conditions carefully before booking a photography session with Batsheva Photography. By booking a session, you agree to be bound by these terms.
1. Booking and Payment:
A non-refundable 15 percent booking fee is required to secure your appointment date and time. This fee will be deducted from the total cost of the appointment.The remaining balance is due, 7 days prior to the session date, on the day of the session.Payments can be made via, bank transfer, credit card, Zelle.Prices are subject to change without notice, but once your session is booked with a deposit, the quoted price will be honored.2. Session Details:
Newborn Sessions: Newborn sessions are ideally scheduled within the first 5-14 days of birth. The exact date will be tentatively booked based on your estimated due date, and we will finalize the date once the baby arrives. Newborn session duration can vary (typically 2-4 hours) to accommodate feeding and soothing.Maternity Sessions: Maternity sessions are typically scheduled between 28-36 weeks of pregnancy.Family Sessions: Session duration and location will be discussed and agreed upon during the booking process.Batsheva Photography reserves the right to reschedule a session due to illness, unforeseen circumstances, or unsafe weather conditions. In such cases, we will work with you to find a mutually agreeable alternative date.3. Client Responsibilities:
Newborn Sessions: Clients are responsible for bringing all necessary items for the baby, including but not limited to diapers, wipes, feeding supplies, extra clothing, and any specific props or outfits they wish to include (unless otherwise agreed upon).All Sessions: Clients are responsible for the timely arrival at the agreed-upon location. Late arrivals may result in a shortened session time.Clients are responsible for the behavior and safety of their children during the session.Please inform Batsheva Photography of any specific needs, allergies, or medical conditions of any family members prior to the session.4. Creative License and Artistic Style:
Batsheva Photography retains the right to use images from the session for promotional purposes, including but not limited to website, social media, and portfolio use. If you prefer not to have your images used, please inform us in writing prior to the session.Batsheva Photography retains full creative license regarding the poses, styling, and overall composition of the images.While we will consider your preferences and suggestions, the final artistic direction remains with the photographer.Minor adjustments and retouching will be performed at the photographer's discretion. Extensive or specific editing requests may incur additional charges.5. Image Delivery and Usage:
Edited images will be delivered within twenty-one business days after activation, depending on the package selected.Digital images will be provided via an online gallery, which can be downloaded and shared.Clients are granted a personal use license for the images, allowing for printing and sharing. Commercial use or alterations are not permitted without prior written consent from Batsheva Photography.Batsheva Photography is not responsible for any printing errors or quality issues that may arise from third-party printing services.Batsheva Photography is not responsible for any loss or damage to the images once delivered to the client.6. Cancellation and Rescheduling:
In the event of cancellation by the client, the booking fee is non- refundable. If the session is canceled within 48 hours of the scheduled date, the full session fee will be forfeited.Rescheduling is allowed with at least 48 hours' notice. A rescheduling fee may apply.Batsheva Photography reserves the right to cancel a session due to unforeseen circumstances, in which case a full refund will be issued.7. Liability:
Batsheva Photography is not liable for any injuries, damages, or losses incurred during the session.Clients are responsible for their own safety and the safety of their children during the session.Batsheva Photography is not liable for any loss or damage to personal property during the session.8. Governing Law:
These terms and conditions shall be governed by and construed in accordance with the laws of the State of New Jersey.Any disputes arising from these terms and conditions shall be resolved in the courts of New Jersey.9. Amendments:
Batsheva Photography reserves the right to amend these terms and conditions at any time. Clients will be notified of any changes prior to their session.10. Acceptance:
